Terms of Service — Still Here

This is the English version of the Still Here Terms of Service, provided for international users and review purposes. The Vietnamese version is available at /terms. If there is any discrepancy, the Vietnamese version prevails.

Please read these Terms of Service (the "Terms") carefully before using the Still Here app ("the app", "the service", "we"). These Terms are a legal agreement between you ("user", "you") and GLD Solutions (household business) (the "operator").

By creating an account or using the service, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, please do not use the service.

1. About the Service

Still Here is a location-based, community-contributed map app with gamification mechanics. Users visit real places/events to check in, contribute photos and descriptions, create and keep places "alive" on the map, earn points, complete quests, compete in seasonal rankings, receive badges, earn cosmetic points to unlock theme colors, and may optionally watch rewarded ads to receive certain in-app benefits (see Section 8).

The service involves real-world activity (traveling to physical places). Please read Section 7 — Real-World Activity Safety carefully.

2. Eligibility (Age & Capacity)

• You must be at least 16 years old to use the service (under Vietnamese law, a person under 16 is considered a child). Minors must have the consent and supervision of a parent/legal guardian.
• You confirm that you have the legal capacity to enter into these Terms.
• You may not use the service if prohibited under applicable law.

3. Accounts

• You need to register an account (via verified email, or Google Sign-In) to use core features.
• You agree to provide accurate information and keep it up to date as needed.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• Notify us immediately if you detect unauthorized use of your account.
• Use only your own account. Do not impersonate others or create accounts for fraudulent purposes.

4. Acceptable Use and Prohibited Conduct

When using the service, you must not:

1. Spoof your location (GPS spoofing), use simulators, automation, bots or any means to create fraudulent check-ins/marks or manipulate scores, rankings, badges, quest progress, cosmetic points or ad rewards (including forging ad-view confirmations).
2. Post content that is illegal, violent, pornographic, harassing, hateful, discriminatory, or fraudulent, or that infringes the rights of others.
3. Post false information about places/events, spam, unauthorized advertising, malicious links, or invitations to join unauthorized groups.
4. Infringe intellectual property, privacy or image rights of others (e.g. posting other people's photos without permission).
5. Upload malware, attempt unauthorized access, scan, sabotage, overload or interfere with the service's systems/security.
6. Scrape other users' data by automated means without permission.
7. Abuse community features (e.g. mass false reporting, junk suggestions).
8. Use the service for unauthorized commercial purposes without our consent.

Violations may result in content removal, point adjustment/rollback, feature restriction, account suspension or deletion (see Sections 8 and 9).

5. User-Generated Content

5.1. Ownership and license

• You retain ownership of the content you create (photos, descriptions, places/events/customs, etc.).
• By posting content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, reproduce, resize and distribute that content for the purpose of operating and promoting the service (e.g. public display on the map, discovery page, check-in feeds).
• This license ends when the content is removed from the system, except where the content has been lawfully saved/shared by others or must be retained by law.

5.2. Your representations about content

You represent that the content you post does not violate any law and that you have all necessary rights to post it. You are responsible for your content.

5.3. Public nature

As stated in the Privacy Policy, content you post may be displayed publicly along with your display name, badges and achievement stats. Do not post information you do not want to be public.

6. Moderation, Reporting and Enforcement

• The service applies content moderation including prohibited-keyword filtering and automated AI screening, combined with community reports.
• When content is reported beyond a threshold or determined to be in violation, it may be automatically hidden or handled by an administrator.
• For score fraud (e.g. fake check-ins), we may adjust/roll back the corresponding points to ensure fairness.
• For ranking-related violations, we may remove you from the current round/division or ban you from the ranking temporarily or indefinitely; quest or ad rewards obtained through fraud may be revoked.
• Certain heritage-type content (e.g. historical sites, intangible cultural heritage) may be protected from automatic hiding and reviewed by an administrator.
• We have the right (but not the obligation) to monitor, review and remove content that violates these Terms.

6.1. What Happens to Content You Report

• As soon as you submit a report, that content is hidden from your own view — it no longer appears on your map, discovery page or lists. Other users still see it normally until a moderation decision is made.
• This stays hidden even if an administrator concludes the content does not violate the rules and dismisses your report. To see it again, withdraw your report under Profile → My reports, or on the content's own page.
• While you have an active report on a place or event, you cannot check in there. Withdrawing the report restores check-in immediately.
• The number of reports you can submit is limited (both how many can be awaiting review at once and how many you can send within a period). Withdrawn reports still count toward the time-based limit — see the Privacy Policy, Section 8.

7. Real-World Activity Safety

Because the service encourages you to travel to real places, you agree that:

• You are responsible for your own safety and for complying with all laws when traveling and checking in.
• Always be aware of your surroundings. Do not use the app while driving, operating a vehicle, or in any situation requiring your full attention.
• Do not trespass on private property, restricted areas, dangerous zones or anywhere you are not permitted to enter.
• Respect other people, local communities, monuments and the environment at the places you visit.
• We are not responsible for any injury, damage, loss or incident arising from your travel or activity while using the service.

8. Points, Quests, Rankings, Virtual Items and Rewarded Ads

8.1. Virtual items

• Life points, ranking scores, reputation, badges, tiers, cosmetic points, theme colors, boost buffs, bonus check-ins and other in-app rewards are virtual items for the gamified experience.
• They have no monetary value, are not property, and cannot be bought, sold or transferred in any form.
• We may adjust, reset, revoke or change the scoring mechanics, thresholds, rewards and game rules at any time, including when handling fraud or system errors. When an account is deleted, virtual items lapse and are not compensated.

8.2. Quests

• The app offers periodic quests (onboarding, daily, surprise, seasonal, event) with rewards such as life points, extra check-ins, badges, cosmetic points or theme colors.
• Quest progress is counted per period and does not carry over; quests not completed by the end of the period lapse.
• We may add, modify or remove quests, or change their rewards, at any time.

8.3. Seasonal ranking

• The leaderboard is organized into seasons, split into rounds and divisions, with tier promotion/demotion based on each round's results.
• When you participate, your display name, tier, score, rank and certain activity stats are publicly visible to other users.
• We may adjust the format (season/round duration, division size, promotion/demotion thresholds) and correct results when fraud or system errors are detected.

8.4. Rewarded ads

• Watching rewarded ads is entirely optional — an ad is shown only when you actively choose to watch it in exchange for the corresponding benefit (an extra check-in, a place rescue, a boost buff, or a theme-color unlock).
• Ads are provided and served by third-party ad networks; ad content is the responsibility of the ad network/advertiser. How these parties process data is described in the Privacy Policy.
• Rewards are granted only after the ad network confirms a valid view with our server; confirmation may be delayed, and a reward session may expire if the ad is not completed.
• Ad rewards are subject to daily limits and other eligibility conditions we define.
• We may enable, disable, change or discontinue the rewarded-ads feature at any time and do not guarantee that ads will always be available.

9. Suspension and Termination

• You may stop using the service and delete your account at any time in the app (see the anonymization mechanism in Section 9 of the Privacy Policy).
• We may suspend or terminate your access, remove content, or lock your account if you violate these Terms, pose a risk to other users or the system, or where required by law.
• Some provisions by their nature survive termination (e.g. limitation of liability, intellectual property, dispute resolution).

10. Our Intellectual Property

• The app, the "Still Here" brand, logo, interface, source code, design and content we provide belong to the operator or its licensors and are protected by law.
• You are granted a limited, non-exclusive, non-transferable personal license to use the service under these Terms. You may not copy, modify, distribute, reverse-engineer or otherwise exploit the service beyond what is permitted.

11. Third-Party Services

The service integrates third-party components (e.g. Google/Firebase, Cloudflare, Mapbox, Resend, eSMS, OpenAI, Expo, AppLovin and ad networks such as Google AdMob and Meta Audience Network). Your use of these may be subject to their own terms and policies. We are not responsible for third-party services.

12. Disclaimers

• The service is provided "as is" and "as available", without warranties of any kind, whether express or implied.
• We do not warrant that the service will be uninterrupted, error-free, perfectly secure, or that location data, maps and place information are accurate, complete or up to date.
• User-generated content does not reflect our views; we do not warrant the accuracy of such content.

13. Limitation of Liability

To the maximum extent permitted by law, the operator and its affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of data, loss of profits, or damages arising from the use of (or inability to use) the service, including real-world activity. Our aggregate liability, if any, is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold the operator harmless from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your violation of these Terms, your violation of law, or your infringement of third-party rights.

15. Changes to the Service and Terms

• We may change, suspend or discontinue part or all of the service at any time.
• We may update these Terms. For material changes, we will update the "Effective date" and, where appropriate, notify you in the app. Your continued use of the service after changes take effect means you accept the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Vietnam. Any dispute will first be resolved through good-faith negotiation; if unresolved, it will be brought before the competent People's Court in Ho Chi Minh City in accordance with the law.
